These terms and conditions govern your use of our website. Please read these terms in full before you use this website. If you do not accept these terms and conditions, please do not use this website. Your continued use of this website confirms your acceptance of these terms.

Website access

1.1 It is not necessary to register with us in order to use most parts of this website. However, particular areas of this website will only be accessible only if you have registered.

Use of website

1.2 This website may be used for your own private purposes and in accordance with these terms and conditions.

1.3 You may print and download material from this website provided that you do not modify or reproduce any content without our prior written consent.

Purchasing

2.0 By purchasing with is you agree to be bound by the Terms and Conditions laid out below. These conditions do not affect your statutory rights as a Consumer. All contracts shall be governed by English Law

2.1 We want all our customers to be happy with their purchase, so we ask that you make sure you are confident in selecting the right product(s) before you confirm your order, i.e. measure the space that the product will be placed in, etc… if you have any questions please feel free to call us on 01257 265793 to check anything you might like to know before you confirm your order.

2.2 Sleepy Hollow Bed Centre retains the right to refuse any order that is subject to an error on its website and will in these circumstances reimburse the Buyer in full.

2.3 Full payment is required at the time the order is placed and Sleepy Hollow Bed Centre will collect the payment from the debit/credit card details supplied. All Prices and charges on this site are in U.K. pounds and include any V.A.T payable at the prevailing rate.

Delivery of your product(s)

3.1. Delivery is carried out by experienced delivery drivers. The delivery time scales stated on the web site are approximate only and Sleepy Hollow Bed Centre will not be liable for any loss suffered by you arising from any delay in the delivery of the product(s). Reasons for delay or non-delivery could be and not limited to: holiday periods i.e. Christmas, Easter; the delivery area is in an area of inaccessibility; or in any other causes whatsoever beyond our control. If you fail to take delivery of the product(s) whenever they are tendered for delivery, then we reserve the right to recover transportation costs.

3.2. Please note it is the customer’s responsibility to ensure access is sufficient to receive the product(s) of your choice. We recommend that you measure the space in which the products are to be placed, especially if goods are for upstairs rooms. If we have to abort delivery due to insufficient access the customer will be liable to pay the direct cost of delivery.

Cancellation of order

4.1. If you wish to cancel any item that was order from stock before delivery has taken place you must notify us by letter or email.

4.2. For all stock Items order online you have 7 days to cancel your order starting the day after the date of delivery. You must cancel your order by letter or email.

4.3. You will be responsible for the cost of returning the goods to the address above and you must take good care of the goods whilst they are in your possession. Goods must be returned within 28 days of notification. If you do not exercise reasonable care and the goods are damaged whilst in your possession or in transit we will not be able to accept the goods. When you return your goods please return in an as new and saleable condition complete with all packaging and accessories supplied. If an item is returned undamaged in its original and undamaged packaging, we will offer you a refund.

4.4. Please note that you’re right to return an item does not apply to certain products unless these items are faulty. Such items include:
- Items which cannot be resold for health and hygiene reasons once unwrapped (for example mattresses, bedding, pillows, etc. that the product seal / bag has been opened);
- Flat pack furniture that has been partially or fully assembled

4.5. Please note; all none stock mattress and bed products sold from this site will be specially ordered from the relevant manufacturer at time of order. None stock mattress and bed products cannot be cancelled once ordered (in stock items will be clearly marked on the website and on your order confirmation – in stock - everything else will be made to order). Please take time to carefully check your order confirmation and report any errors by e-mail within 24 hours of receipt.

Return of damaged / faulty items

5.1. When your goods are delivered please check that the order is complete and not damaged. In the event that your order is visibly damaged, do not accept the order and enter on the delivery note “Damaged” along with a brief description of how or where the item is damaged.

5.2. If you have accepted the goods and subsequently discover that they are faulty / parts are missing, you must notify us in writing by letter or email and if required send images to highlight the issue. You will be entitled to a replacement or repair. Where a replacement/repair is not possible e.g. because the product/parts no longer exist then a refund will be offered. In this case do not use the Goods and inform us as soon as possible following the date of receipt describing the problem in as much detail as possible. Please retain all original packaging.

Refunds

6.1. Once we have been notified of the cancelling of the contract, we will refund or re-credit you within 30 days for any sum that has been paid or debited from your credit card for the products. This refund will be subject to a 3.5% surcharge, the cost of the credit/debit card transaction charged to us by our payment processor. This charge has been built into the price of the products.

Product Descriptions / Images

7.1. There may be certain items included in the illustration of a product which are not part of the product and are not included in the product description and are not part of the order, unless stated (for example, bedside tables, lamps, Headboards, bed covers). Goods are supplied on the understanding that there may be slight variances in colour, finish, shade and grain. Materials may have minor technical differences and their appearance may differ slightly from the goods shown. Any changes will be of an equal or higher standard to those displayed and will not materially affect the products quality or performance. Measurements provided on the website are for guide purposes only and may not be taken as exact. All products supplied are subject to a tolerance of + - 2%.

Guarantees

8.1. All Goods are guaranteed against faulty materials and workmanship for a minimum period of twelve months from the date of delivery. The manufacturer(s) of your particular product(s) may offer a guarantee(s) of various periods on the product(s) from the date of delivery of the product(s). Please note that the terms of any manufacturer's guarantee shall be attached to your product(s) on delivery and is offered as an extra benefit and does not affect your statutory rights as a consumer. Any complaints made by you in the first year should be made initially by e-mail to us, quoting your order reference number and outlining the nature of your complaint. We shall then liaise with the manufacturer on your behalf and keep you fully informed of how the matter is progressing.

9.1 Throughout this website you may find links to third party websites. The provision of a link to such a website does not mean that we endorse that website. If you visit any website via a link on this website you do so at your own risk.

9.2 Any party wishing to link to this website is entitled to do so provided that the conditions below are observed:

(a) you do not seek to imply that we are endorsing the services or products of another party unless this has been agreed with us in writing;

(b) you do not misrepresent your relationship with this website; and

(c) the website from which you link to this website does not contain offensive or otherwise controversial content or, content that infringes any intellectual property rights or other rights of a third party.

9.3 By linking to this website in breach of clause 1.10 you shall indemnify us for any loss or damage suffered to this website as a result of such linking.

10.2 All material contained on this website is provided without any or warranty of any kind. You use the material on this website at your own discretion.

Exclusion of liability

11.1 We do not accept liability for any loss or damage that you suffer as a result of using this website.

11.2 Nothing in these terms and conditions shall exclude or limit liability for death or personal injury caused by negligence which cannot be excluded or under the law of the United Kingdom.

Law and jurisdiction

These terms and conditions are governed by English law. Any dispute arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Courts of England and Wales.
