Sleepy Hollow Bedroom Centre operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Sleepy Hollow Bedroom Centre is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”) describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy [LINK]. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

1. Guarantee
1.1 We undertake to honour the terms and conditions relating to any manufacturer's warranty.
1.2 Regarding warranty on all manufactured products, for a period of one year from delivery of our product(s), any defects
arising out of defective materials provided by ourselves, or defective workmanship on the part of our companies, will be
rectified by us as soon as is practicable after notification by the Customer, provided that we are satisfied that such defects
arise out of defective materials or workmanship supplied or carried out by our business.

2. Commencement and Completion
2.1 Products will be delivered to schedule as agreed at the point of ordering or within a reasonable time of confirmation of
your order, or if there is a period agreed for the delivery, within the period so agreed.
2.2 Our company shall not be liable for delays in the delivery of a product, due to lack of, or inadequate instructions given
by the Customer, or delays caused by third parties, such as manufacturers, couriers or subcontractors.
2.3 If we are delayed or prevented in the execution of work due to any acts or omissions by the Customer, or anybody for
whom the customer is responsible our Company shall be entitled to recover from the Customer any additional costs arising
from such delay or disruption.


3. Price
3.1 The price quoted by ourselves is for the supply of goods, and/or the execution of delivery (where applicable), as
described within the sales order and supporting paperwork. Where applicable, V.A.T is charged at the current rate.
3.2 It is the responsibility of the Customer to ensure adequate provision is made for the delivery (where applicable) of the
items ordered. Costs incurred due to redelivery caused due to lack of access, room readiness, etc, then we reserve the right
to charge for a repeat delivery service (currently £29).
3.3 Any quotation given is valid for a minimum of 28 days. We will always endeavour to maintain the quoted price. The
quotation is based on material and labour costs prevailing at the date of quotation, and should there be any subsequent
alteration in costs we reserve the right to revise the price(s) accordingly.

4. Payment
4.1 Payment in full shall be made by the customer to ourselves in accordance with conditions 4.2 and 4.3 hereof.
4.2 We will submit, at the time of order, an itemised Sales Order, stating the initial payment paid and the remaining
amounts due. Final payment is due at least 48 hours prior to delivery of goods.
4.3 If the Customer fails to make payment on the due date, we shall not be liable for any delays in delivery or completion of
work within previously agreed timescales.
4.4 When paying ourselves a part payment against goods or services ordered, the Customer accepts these Terms and
Conditions of Supply as part of the Contract of Sale.
4.5 Part payments paid against products or services are not refundable, should a customer subsequently cancel an order in
breach of the Sale of Goods Act, Sleepy Hollow Bedroom Centre Ltd / Tarleton Bed Store may, at its complete discretion,
offer a credit note.

5. Materials, Risk and Retention of Title
5.1 The materials supplied by or on behalf of ourselves shall remain the property of Sleepy Hollow Bedroom Centre Ltd /
Tarleton Bed Store until the Customer has paid to ourselves, in full, all sums payable or which become payable, by the
customer in accordance with the order.
5.2 Although the materials remain the property of Sleepy Hollow Bedroom Centre Ltd / Tarleton Bed Store until all sums
due have been paid, they shall pass to the Customer's risk at time of delivery, in such cases as a final payment is agreed.
5.3 Special Order products must be paid in full prior to commencement of being manufactured. These products are
non-refundable and cannot be returned. Any delay in payment from the customer will affect the delivery of these items, and
this will be the customers responsibility, and not the liability of ourselves.


6. Indemnity and Insurance, Limitation of Liability, Force Majeure
6.1 Public liability Insurance is underwritten by NFU Mutual.
6.2 Sleepy Hollow Bedroom Centre Ltd & Tarleton bed store shall not be liable for any loss or damage suffered by the
Customer or any third party which is caused, in our sole opinion, by issues(whether latent or patent, and whether or not the
same have been brought to our attention) affecting our delivery service.
6.3 If Sleepy Hollow Bedroom Centre Ltd / Tarleton Bed store is affected by Force Majeure (which shall mean any
circumstances beyond its reasonable control eg: industrial action, issues affecting our supply chain, etc) then we shall notify
the Customer of the extent and nature of it. Sleepy Hollow Bedroom Centre Ltd / Tarleton Bed Store shall not be deemed to
be in breach of contract by reason of any delay in performance, or non-performance, of any of its obligations under any
contract to the extent that such delay is due to Force Majeure, and time for that obligation shall be extended accordingly.


7. Failed Deliveries & restocking Fees
If a delivery cannot be completed due to access issues, when we have been advised of no issues, then a second delivery
may be attempted, (eg: return visit due to no access) then a charge of £29 will be incurred. If amending a store order after
48 hrs from ordering you will be charged an administration fee of 20% of the value of your goods. Each product is
considered a specialist, made to order item, and therefore is a non-returnable item. Beyond 48 hours from ordering, you will
not be able to cancel or return your item(s). If you wish to cancel your order this will be subject to a 20% restocking fee. In
extraordinary circumstances, if you are not happy with your choice of bed/mattress and wish to return your item (for
example it will not fit) a restocking fee of 20% will be charged plus a £29 collection fee, and is at the discretion of the
company. Mattresses are delivered in a sealed hygiene bag, once the seal is broken you are no longer able to return or
exchange your mattress. If you discover a fault with your bed/mattress these are of course covered by the manufacturer's
warranty which commences on your delivery date.
